The following regulations of the hiogi GmbH, Ackerstrasse 3a, 10115 Berlin, Germany apply to the use of the hiogi platform via internet or mobile telephone system.
According to the German Data Protection Act (BDSG), the processing and using of data is allowed in case the BDSG or another law allows it and the person concerned permits it. The BDSG always permits the processing and using of data in case it is done within the scope of the purpose of a contractual relationship or a quasi-contractual relationship on mutual trust. Processing of data is also permitted, if necessary, to protect the legitimate interests of the place storing them and of third parties for example of a receiver. Furthermore, it is also allowed when there is no reason to believe that the protectable interest of the person concerned prevails in processing or using and that this person has such a protectable interest.
Data Collection and Storage by hiogi
- The hiogi GmbH collects and stores the following information in order to increase the security of the hiogi platform and to optimize the offer in case the internet browser of the user transfers these to the server of the hiogi platform. These are internet browser type/ -version, operating system, host name of the accessing computer (IP address), time of server request. This data collection is done without personalization of the respective user.
- The hiogi platform uses cookies. Cookies are small text files stored on the computer of the user should the internet browser of the user admit it. They serve the statistic analysis of the use of the hiogi online platform and facilitate certain usages of the hiogi platform on side of the user. Cookies do not contain any personal data. The user may delete them at any time and prevent the storage by a specific configuration of his internet browser software.
- The registration on hiogi requires the ascertainment of so-called master data from the user for the implementation of the contract. These are, among others, username, password, number of mobile phone, acceptance of the terms and conditions, privacy policy. These data are necessary for identification of the user and the duly execution of the contract. The user can see these data in his user account and edit them, if necessary.
- When using the hiogi online platform the user name (pseudonym or username), freely chosen by the user himself and the profile rating are visible for other hiogi users. Contents submitted by the user under his user name are available to third parties through the hiogi search function. In case of the only use of the hiogi platform by SMS, the mobile phone number and the provider of the user will be stored and mentioned on the web site as “anonym”, until the user registers under his user name (username).
- The hiogi GmbH also files data which are not master data in case they are given by the user. It is not compulsory to give these data. The hiogi GmbH uses these data for improving its own service and for promotional information of the user.
- The hiogi GmbH uses the email address, the user saved during the registration for processing the correspondence with the user necessary for the contract. In addition, the hiogi GmbH has the right to send general information or information with advertising character (e. g. Newsletters) to the user’s email address. The user has the right to cancel this information by changing the user settings of the user account or by activating a cancellation link.
- Should the hiogi GmbH have active tangible proof of the use of the services of hiogi illegally and contrary to the contract, it will collect, process and use master data and usage data as far as it is necessary for prevention and uncovering. For this purpose, the hiogi GmbH has the right to collect user data by using cookies.
Analysis
The hiogi websites use Google Analytics, a web analysis service of Google Inc. ("Google") Google Analytics uses "cookies", text files, which will be saved on your computer and which allow an analysis of your use of the hiogi website(s). The information provided by the cookie concerning your use of the website (including your IP-address) will be transferred to a Google server in USA and saved there. Google will use this information to analyze your use of the hiogi website(s), to compile reports about the website(s) activities for the website(s) operator and to provide additional services concerning the website(s) and internet utilization. Google may transfer this information to third parties, if this is a legal requirement or if third parties are commissioned by Google to process the information. Google will in no event connect your IP-address with other Google data. You can prevent the installation of cookies with the relevant browser software setting however we would like to point out that in this case you may not be able to use all the functions on this website to the full extent. Through use of the hiogi website(s) you agree to the processing of your data by Google in the way described above and for the purpose stated above.

User’s data Transmission to a Third Party
As a matter of principle, the hiogi GmbH does not give any personal data of the user to third parties, only in case of legal obligations (law enforcement agency), or unless the user has agreed to it by express statement.
For sending the answer to the mobile phone number of the user, it is necessary for the SMS routing to give the phone number to the SMS aggregator and mobile operators.
Right of Objection and Right of Access to Personal Data
Under the German Data Protection Act (BDSG) and under the conditions stipulated therein, the user has the right to edit, disable and delete the user data stored by hiogi for the future. In any case, the user has the right of discovery that the user can claim at any time.
